Terms of Use
CosmoPier Inc. (hereinafter referred to as "the Company") hereby establishes the following Terms of Use (hereinafter referred to as "these Terms") for the use of the CosmoPier e-Station Global Series operated by the Company (hereinafter referred to as "the Site").
Article 1: Scope and Purpose of These Terms
1. These Terms apply to all actions by users when using the services provided on the Site operated by the Company.
2. These Terms set forth the conditions for using the services. Users shall use the services in accordance with these Terms.
Article 2: Definitions
1. The definitions of the terms used in these Terms are as follows:
(1) "The Site": The website operated by the Company under the name "CosmoPier e-Station Global Series."
(2) "The Services": All services provided on the Site. The specific content of the services shall be determined by the Company.
(3) "User": Any person who accesses the Site and uses the Services.
(4) "Member": Users who meet the conditions specified in Article 8.
Article 3: Use of the Site
Users shall be deemed to have agreed to the CosmoPier e-Station Global Series Terms of Use (hereinafter referred to as "these Terms") at the time they browse the Site or apply for and register to purchase products or services (hereinafter referred to as “Contracts”).
Article 4: Changes to These Terms
1. The Company may revise these Terms at any time without the user’s consent. In such cases, the use of the Site shall be governed by the revised Terms.
2. The revised Terms shall take effect from the time they are posted on the Site by the Company.
3. If a user continues to use the services after the revised Terms have taken effect, the user shall be deemed to have agreed to all revised content of the Terms.
Article 5: Copyright on the Site
1. All content on this Site (including but not limited to text, images, audio clips, and digitally downloadable data) is the intellectual property of the Company and protected by copyright (including rights under Articles 27 and 28 of the Copyright Act) and other applicable laws. Reproduction, modification, distribution, sale, or publication to third parties without prior written permission from the Company is prohibited.
2. The Company makes no guarantees regarding the completeness, accuracy, usefulness, fitness for a particular purpose, or non-infringement of third-party rights of the information provided on the Site and is under no obligation to investigate such matters.
3. Users may not use the information provided on this Site for purposes other than personal use (including but not limited to reproduction, distribution, public transmission, broadcasting, sale, lending, or modification) without prior written consent from the Company. Violators may be subject to penalties under copyright law.
Article 6: Changes to Services
The Company reserves the right to change, suspend, add, or discontinue any part of the services on this Site at any time without prior notice to users.
Article 7: Suspension of the Site
1. The Company may temporarily or permanently suspend the Site without prior notice due to system failures, server maintenance, or other reasons. The Company shall not be liable for any damages resulting from such suspension.
Article 8: Membership
1. A "Member" refers to a person who, having agreed to all provisions of these Terms, applies for membership in accordance with the Company’s prescribed procedures and is approved by the Company. Applicants must provide true and accurate information when registering.
2. The Company may refuse membership registration at its sole discretion in any of the following cases:
a) If the applicant provides false information at the time of registration.
b) If the Company determines that approving the application is inappropriate for operational or technical reasons.
3. Individuals may register only once. Users who are already registered may not register again under the same name.
4. Members may use member-only services on the Site (hereinafter referred to as “Member Services”).
5. The Company may send notifications about new services, advertisements related to the Company’s or third parties’ products or services, administrative communications, and other information to members via electronic means.
6. Membership rights may not be transferred or loaned to any third party.
Article 9: Member Registration
1. To use and purchase products or services on this site for the first time, users must register as a member. Users shall enter the required information (such as email address, delivery address, name, and phone number) on the member registration page.
2. If purchasing products using a credit card, users must use a card under their own name.
3. The Company will send a confirmation email to approve the membership registration when the application is accepted.
Article 10: Password Management
1. The Company will issue an ID and password necessary to use the services to each member.
2. Members are responsible for managing their assigned ID and password.
3. Members must not transfer, lend, or disclose their password to any third party. The Company shall not be held responsible for any misuse or unauthorized use.
4. Members shall bear all responsibility for damages caused by improper management of their passwords.
5. Members must not allow third parties to use their ID or password, nor transfer, lend, or pledge them. If such actions are discovered, the account may be suspended.
6. If a third party uses a member's ID and password to access the services, such use will be deemed use by the member, and the member shall bear all related liabilities, including payment of fees.
7. In case of loss or theft of ID or password, the member must immediately notify the Company and follow the Company’s instructions.
Article 11: Formation of Sales Contracts
1. A service agreement and sales contract between the user and the Company shall be deemed established when the Company receives the user's order details and sends a confirmation email to the email address provided by the user.
2. If necessary, the Company may contact the user by phone to confirm payment methods or order details.
Article 12: Completion of Formal Order Procedures
The "Completion of Formal Order Procedures" shall be deemed to occur when the Company receives the user’s order details and sends a confirmation email to the user's server as described in the previous article. At this point, production for made-to-order items will begin, and shipping procedures for other products will be initiated.
Article 13: Notes Regarding Downloadable Products
The validity period for downloading purchased products after payment is as follows. No guarantee will be provided after this period:
- Download period: Within 14 days after payment processing.
Article 14: Payment
1. The payment amount for downloadable products includes the product price and consumption tax.
2. Credit card payment processing for this site is handled by Remise Corporation through the “Remise” service. See the “Remise” website for details.
3. Payment for products and services purchased on this site must be made using a credit card under the user’s own name.
4. Accepted credit cards include NICOS, VISA, MasterCard, JCB, American Express, MUFG Card, DC, and TOYOTA.
5. Credit card payments are subject to the terms agreed between the user and their credit card provider. In the event of any dispute between the user and the credit card company, the matter shall be resolved directly between those parties. The Company shall not be liable.
Article 15: Cancellation and Termination of Sales Contracts
Even after accepting an order from the user, the Company may cancel the contract for any of the following reasons:
1. If the user fails the credit card company’s screening process and the order is not approved.
2. If false information is found in the user’s personal information.
3. If there is a reason to believe that the user’s ability to pay is in question.
4. If the Company otherwise deems the order unacceptable.
Article 16: Prohibited Acts
1. Users shall not engage in any of the following acts when using this site:
1) Submitting false information during account registration.
2) Attempting unauthorized access to the Site.
3) Unauthorized use of email addresses, IDs, or passwords.
4) Infringing or threatening to infringe the copyrights, privacy, or other rights of other users, third parties, or the Company.
5) Engaging in or threatening to engage in acts that violate public order, morals, or laws.
6) Acts connected to criminal activity.
7) Infringement of copyrights, trademarks, image rights, or other rights of the Company or third parties.
8) Infringement of property or privacy of the Company or third parties.
9) Defaming, slandering, or damaging the reputation or trust of the Company or third parties.
10) Sending information that contains malicious programs.
11) Engaging in pre-election campaigning, election campaigning, or similar acts in violation of the Public Offices Election Act.
12) Religious proselytizing or related acts.
13) Engaging in or preparing for profit-oriented business activities.
14) Engaging in acts that disrupt the operation of the Site or damage its credibility.
15) Unauthorized reproduction, modification, or redistribution of Site content.
16) Soliciting money, goods, or investments under any name, including donations or offerings.
17) Collecting customer information for unauthorized purposes.
18) Disclosing or leaking personal information (such as addresses, names, and phone numbers) of other users or third parties obtained through the Service.
19) Using the Company’s trade name, trademarks, or logos to falsely imply a partnership or authority as an agent.
20) Any other act that violates these Terms or laws, or is against public order and morals.
21) Any other acts that the Company deems inappropriate.
Article 17: Cancellation and Returns
Products and services on this site cannot be canceled, exchanged, or refunded.
Article 18: Order Acceptance Area
Downloadable products are not supported for users residing outside Japan.
Article 19: Member Cooperation
1. The Company may conduct surveys or interviews with members via the Site, email, or postal mail.
2. All copyrights and intellectual property rights of the information provided by members in such surveys belong to the Company.
Article 20: Handling of Member Information
1. Members agree that the information they registered during the application process in Article 8 (hereinafter “Member Information”) and information regarding their use of the Site’s services (hereinafter “Usage Information”) will be stored in the Company’s database.
2. If any changes occur in the Member Information, members shall promptly update it through the designated procedures.
3. The Company may use Member Information and Usage Information for site management and service delivery, as well as for information provision purposes as specified in Article 8, Paragraph 5, in accordance with its Privacy Policy.
4. The Company may freely use Member and Usage Information in anonymized statistical form for business purposes.
5. The Company will not disclose Member Information that identifies individuals to third parties, except in the following cases:
(1) When the member consents.
(2) When disclosure is required by law.
(3) When necessary for providing the service, such as outsourcing product delivery.
6. Members acknowledge that the Company has no obligation to store Usage Information, and that they are responsible for backing up necessary data.
7. For details on how Member Information is handled, please refer to the Company’s Privacy Policy.
Article 21: Revocation of Membership
1. The Company may revoke membership if:
(1) The member engages in any acts deemed to fall under the prohibitions of Article 16.
(2) False information is discovered in the registration.
(3) Any other violation of these Terms is committed.
2. The Company shall not be liable for any damages incurred by the user as a result of the loss of membership as described above.
Article 22: Suspension or Termination of Membership
1. If a member requests to stop using the service, billing will be halted and access will be suspended.
2. To terminate membership, the member must fill out the required form via My Page. Upon processing, the membership will end. All learning history will become invalid.
3. A user who has canceled their membership may re-register only after three months from the date of cancellation.
4. Users who cancel during the free trial period specified in Article 11, Paragraph 2, may not re-register under the same name thereafter.
Article 23: Protection of Personal Information
This site collects and stores users’ personal information in a database during activities such as product purchases and member registration. Registered information is used to manage product purchases, notifications, and correspondence courses. Such information will not be sold, provided, or rented to third parties.
Article 24: Security and Authentication
This site uses SSL (Secure Socket Layer), the most reliable and widely adopted encryption technology available on the internet, to protect personal information. However, the Company does not guarantee its safety. In the unlikely event that data leakage occurs without the Company's fault, the Company assumes no responsibility.
Article 25: Disclaimer
1. The Company shall not be liable for any disadvantage or damage incurred by users or third parties due to the temporary suspension or discontinuation of part or all of the services, or due to changes, additions, or termination of the services or these Terms, regardless of the reason.
2. The Company assumes no liability for any disadvantage or damage incurred by users resulting from the use of the services.
3. Users shall use the services at their own risk, and the Company is not involved in users' communication or activities. The Company shall not be liable for any damage incurred by users and is not obligated to compensate for such damage.
4. If a user causes harm to a third party through use of the services, the user shall resolve the issue at their own responsibility and expense. The Company bears no responsibility.
5. If a user violates any of the Terms and causes damage to the Company, the Company may claim compensation for damages, including reasonable attorney fees.
6. Transactions between users and advertisers whose advertisements appear on this site are the responsibility of the parties involved. The Company assumes no responsibility for disputes or damages arising from such advertisements or transactions.
7. The Company does not guarantee the content of websites linked from this site and assumes no responsibility for any resulting damages.
Article 26: Governing Law
The interpretation and application of these Terms shall be governed by Japanese law.
